Welcome to MycoStudio. These Terms of Service ("Terms") govern your access to and use of the MycoStudio website, online store, and all related services (collectively, the "Service") operated by MycoStudio ("we," "us," or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you should not use the Service.
1. ACCEPTANCE OF TERMS
By visiting our website, browsing our store, creating an account, or making a purchase, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.
If you are under the age of 18, you must have the consent of a parent or legal guardian to use the Service.
2. ACCOUNT REGISTRATION
Certain features of the Service may require you to create an account. When creating an account, you agree to:

3. PRODUCTS AND DIGITAL DELIVERY
3.1 NATURE OF PRODUCTS
All products sold through the Service are digital goods, including but not limited to audio plugins, presets, sound packs, and related digital materials. No physical goods are shipped.
3.2 DELIVERY
Upon successful payment, digital products are delivered instantly via download link. Download links are provided on the order confirmation page and via email. You are responsible for downloading your purchased products promptly.
3.3 DOWNLOAD AVAILABILITY
We make reasonable efforts to keep download links active. However, we recommend downloading your purchases as soon as possible after completing your order. If you experience issues accessing your downloads, contact support@mycosounds.com.
3.4 PRODUCT DESCRIPTIONS
We strive to provide accurate descriptions of our products. However, we do not warrant that product descriptions, images, or other content on the Service are complete, accurate, or error-free.
3.5 COMPATIBILITY
It is your responsibility to verify that products are compatible with your software and system before purchasing. Product pages list compatibility requirements — please review them carefully.
4. PRICING AND PAYMENT
4.1 PRICING
All prices are displayed in US Dollars (USD) unless otherwise noted. Prices are subject to change without notice. The price in effect at the time of your purchase will be the price you pay.
4.2 PAYMENT
Payments are processed through our third-party payment processors (including Shopify Payments and Stripe). By making a purchase, you agree to the terms of service of the applicable payment processor.
We accept major credit cards, debit cards, and other payment methods as displayed at checkout.
4.3 TAXES
Applicable taxes (sales tax, VAT, GST, or other taxes) may be added to your order based on your location and applicable law. You are responsible for any taxes associated with your purchase.
4.4 CURRENCY
Prices are listed in USD. If you are paying in a different currency, your payment processor or bank may apply conversion fees. We are not responsible for any currency conversion charges.
5. LICENSE AND INTELLECTUAL PROPERTY
5.1 PRODUCT LICENSE
All products are licensed, not sold. Your use of purchased products is governed by the MycoStudio License Agreement included with each product. Please review the License Agreement carefully before using any products.
5.2 WEBSITE CONTENT
All content on the Service, including text, graphics, logos, images, audio clips, and software, is the property of MycoStudio or its content suppliers and is protected by copyright, trademark, and other intellectual property laws.
5.3 RESTRICTIONS
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any content from the Service except as expressly permitted in these Terms or the applicable License Agreement.
5.4 TRADEMARKS
"MycoStudio," the MycoStudio logo, and all related names, logos, product and service names, designs, and slogans are trademarks of MycoStudio. You may not use such marks without our prior written permission.
6. USER CONDUCT
When using the Service, you agree NOT to:
a) Violate any applicable law, regulation, or these Terms.
b) Infringe upon the intellectual property rights of MycoStudio or any third party.
c) Attempt to gain unauthorized access to any part of the Service, other accounts, or any systems or networks connected to the Service.
d) Use any automated means (bots, scrapers, crawlers) to access the Service or collect data from it without our express written consent.
e) Interfere with or disrupt the Service or servers and networks connected to the Service.
f) Transmit any malware, viruses, or other harmful code.
g) Engage in fraudulent activity, including but not limited to using stolen payment information or filing false chargebacks.
h) Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
i) Use the Service for any purpose that is unlawful or prohibited by these Terms.
7. CHARGEBACKS AND FRAUD
We take payment fraud seriously. If a chargeback is filed fraudulently (i.e., after you have downloaded and used the Product), we reserve the right to:
a) Terminate your account and revoke all licenses.
b) Report the fraudulent activity to the appropriate authorities.
c) Pursue any available legal remedies.
If you have a legitimate issue with a purchase, please contact us at support@mycosounds.com before initiating a chargeback with your bank or credit card company.
8. THIRD-PARTY SERVICES
The Service may contain links to third-party websites, services, or content that are not owned or controlled by MycoStudio. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.
Our store is hosted on Shopify. Your use of the store is also subject to Shopify's terms of service. Payment processing is handled by third-party processors subject to their own terms.
9. DISCLAIMER OF WARRANTIES
THE SERVICE AND ALL PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE,
SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
10. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MYCOSTUDIO AND ITS
OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE OR PRODUCTS.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO MYCOSTUDIO IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
11. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless MycoStudio and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with:
a) Your use of the Service or Products. b) Your violation of these Terms. c) Your violation of any third-party rights, including intellectual property rights.
12. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of such courts.
Before filing any legal action, you agree to attempt to resolve the dispute informally by contacting us at support@mycosounds.com. We will attempt to resolve the dispute through good-faith negotiation for at least thirty (30) days before either party may initiate formal proceedings.
13. SEVERABILITY
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
14. WAIVER
The failure of MycoStudio to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by MycoStudio.
15. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy, Refund Policy, and applicable License Agreement, constitute the entire agreement between you and MycoStudio regarding the Service and supersede all prior agreements and understandings.
